PUTRAJAYA: The Court of Appeal has partially allowed an appeal by Datuk Seri Abdul Azeez Abdul Rahim’s appeal to strike out his 13 corruption and money-laundering charges.
A three-member panel chaired by Justice Kamaludin Md Said unanimously dismissed Abdul Azeez’s appeal with the exception of the third, seventh, eighth and ninth charges here on Monday (Sept 5).
This means Abdul Azeez still needs to answer nine out of the 13 charges he is facing in his trial at the Sessions Court.
Other judges on the bench were Justices Abu Bakar Jais and Che Mohd Ruzima Ghazali.
In the decision, which was read by Justice Abu Bakar, the panel disagreed with the appellant who sought to strike out all 13 charges, except for the third, seventh, eighth and ninth, under the Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.
“We found it is not true that all of the charges are defective.
“It is untrue to say (all) the charges against the appellant are baseless and invalid.
“We are also of the opinion that the appellant’s argument that the charges against him are mala fide (in bad faith) is baseless,” Justice Abu Bakar said.
The court said it was inappropriate to set aside the remaining nine charges against Abdul Azeez and that he must answer those charges at the Sessions Court.
